{"id":7308,"date":"2024-04-22T19:26:27","date_gmt":"2024-04-22T19:26:27","guid":{"rendered":"https:\/\/tup.kxe.temporary.site\/legal-risks-loom-for-firefly-users-after-adobes-ai-image-tool-training-exposed\/"},"modified":"2024-04-22T19:26:27","modified_gmt":"2024-04-22T19:26:27","slug":"legal-risks-loom-for-firefly-users-after-adobes-ai-image-tool-training-exposed","status":"publish","type":"post","link":"https:\/\/okdesign.ca\/en\/legal-risks-loom-for-firefly-users-after-adobes-ai-image-tool-training-exposed\/","title":{"rendered":"Legal risks loom for Firefly users after Adobe\u2019s AI image tool training exposed"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>Adobe\u2019s Firefly was designed to give enterprise users generative AI image tools they could trust.\u00a0<\/p>\n<p>\u201cA lot of our very big enterprise customers are very concerned about using generative AI without understanding how it was trained,\u201d Adobe chief strategy officer Scott Belsky <a rel=\"nofollow noopener\" href=\"https:\/\/techcrunch.com\/2023\/06\/26\/adobe-indemnity-clause-designed-to-ease-enterprise-fears-about-ai-generated-art\/\" target=\"_blank\">told TechCrunch<\/a> last year. \u201cThey don\u2019t see it as viable for commercial use in a similar way to using a stock image and making sure that if you\u2019re going to use it in a campaign you better have the rights for it \u2014 and model releases and everything else. There\u2019s that level of scrutiny and concern around the viability for commercial use.\u201d<\/p>\n<p>The company said Firefly was only trained on licensed content from Adobe\u2019s image banks. To back up that claim, they provided enterprise users with full legal indemnification for any content created using it. This is \u201ca proof point that we stand behind the commercial safety and readiness of these features,\u201d Claude Alexandre, the company\u2019s VP of digital media, said at last year\u2019s Adobe Summit.\u00a0<\/p>\n<p><!-- \/1038259\/MT_Post-text --><\/p>\n<p>Unfortunately, or perhaps inevitably, this wasn\u2019t entirely true. A Bloomberg report found Firefly was trained, in part, on AI-generated images. Some of these came from Midjourney, an AI many believe was trained on images scraped from the web.\u00a0<\/p>\n<p>This has created a big marketing problem for Adobe and potentially a big legal problem for Firefly\u2019s users. It also highlights IP issues that hang over all of AI and that can only be solved by law.\u00a0<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-the-5-solution\">The 5% solution<\/h2>\n<p>Adobe said the images from Midjourney only made up 5% of the training material. That\u2019s not a great defense. The company has 248 million images under license, so that \u201conly\u201d could be up to 1.25 million pictures.<\/p>\n<p>\u201cIt doesn\u2019t matter if it\u2019s 5%, 1%, 000.1%,\u201d said Katie Robbert, CEO and co-founder of Trust Insights, and <a rel=\"nofollow noopener\" href=\"https:\/\/martech.org\/author\/katie-robbert\/\" target=\"_blank\">a MarTech contributor<\/a>. \u201cYou are making the declarative statements of what your product does and doesn\u2019t do. And when it\u2019s shown that what you\u2019re saying is not true, then you\u2019re no longer a trustworthy brand.\u201d<\/p>\n<p>In addition to brand damage, it also means Firefly doesn\u2019t solve the problem it is supposed to.<\/p>\n<p><strong><em>Dig deeper: <\/em><\/strong><a rel=\"nofollow noopener\" href=\"https:\/\/martech.org\/examples-ai-in-marketing\/\" target=\"_blank\"><strong><em>AI in marketing: Examples to help your team today<\/em><\/strong><\/a><\/p>\n<p>\u201cI don\u2019t think there\u2019s a high degree of concern that you\u2019re going to generate something that someone\u2019s going to come back and say, that\u2019s mine,\u201d Robbert said. \u201cBut we don\u2019t know that. And that\u2019s the problem. Users are stuck in this limbo of \u2018Can I use it safely, or can\u2019t I?\u2019 We don\u2019t know.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-brands-at-risk\">Brands at risk<\/h2>\n<p>What that means is a lot of marketers for big brands who rely on Firefly are now looking for something that will ensure they have the legal right to use the images they create. \u201cBecause the last thing I need is a lawsuit because I just wanted to put an image on my blog,\u201d said Robbert.<\/p>\n<p>In the event of a lawsuit, it\u2019s the brand and not Adobe that\u2019s at risk.<\/p>\n<p>\u201cI\u2019m not an IP attorney, but I believe the end user is the one who\u2019s liable for the use of the tool,\u201d said Paul Roetzer, CEO of The Marketing AI Institute. \u201cSo if there is some massive class action lawsuit and it\u2019s determined that these models were actually illegally trained, the end user is the one that\u2019s going to get caught up in it.\u201d<\/p>\n<p>Roetzer said the best remedy for this situation is a legal one. The EU already has regulations in place to deal with this. The AI Act requires providers to provide the public with a detailed summary of the content used for training their models. It also has limited exceptions for text and data mining, which balance copyright protection with promoting innovation and research.\u00a0<\/p>\n<p>In the U.S. it currently looks like regulations may come about because of lawsuits, not legislation. Roetzer said that means the technology will continue to outpace the law.<\/p>\n<p>\u201cThese models are going to advance so much more before we ever have any meaningful lawsuits that get to the point where we have regulations that cover this,\u201d he said.<\/p>\n<p>The speed of innovation, fueled by consumer demand, is only going to compound the problem.<\/p>\n<hr\/>\n<hr\/>\n<p>\u201cPeople are going to want the most advanced technology,\u201d Roetzer said. \u201cThat technology may or may not have been trained on things they probably shouldn\u2019t have been trained on.
