When it\u2019s making decisions about its own operations and strategy, European regulators have a seat at the table \u2014 and a very loud voice.<\/p>\n<p>No, that\u2019s not something entirely new; but interventions in the tech space (impacting martech and <a rel=\"nofollow\" href=\"https:\/\/martech.org\/why-we-care-about-adtech-the-complete-guide\/\">adtech<\/a>) are becoming increasingly frequent.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-we-have-some-questions-about-crowdtangle\">We have some questions about CrowdTangle<\/h2>\n<p>The latest intervention followed Meta\u2019s announcement that it was withdrawing CrowdTangle. CrowdTangle, to put it simply, was a resource that could be used by researchers, journalists and ordinary citizens to analyze content on Facebook and Instagram. It was an especially useful tool for evaluating the presence and volume of disinformation and other toxic content.<\/p>\n<p>The timing of the announcement alone, about three months out from the U.S. presidential election, is enough to make one wince. Don\u2019t worry, said Meta, we still have Meta Content Library, you can <a rel=\"nofollow\" href=\"https:\/\/transparency.meta.com\/researchtools\/other-datasets\/crowdtangle\">use that instead<\/a>. Spend a few minutes perusing the application form to use Content Library, though, and it becomes clear that it\u2019s really available only to academic researchers that can identify the academic institution with which they\u2019re affiliated. Advocacy groups, journalists and other interested parties would have to turn somersaults to get access.<\/p>\n<p>The European Commission, however, did more than just wince. After the news became public it issued a Request for Information to clarify whether Meta was continuing to fulfill its obligations under the Digital Services Act (DSA). The DSA does set out requirements for platforms like Meta to allow certain access to data.<\/p>\n<p>You may have missed it at the time, but the Commission had <a rel=\"nofollow\" href=\"https:\/\/www.euronews.com\/my-europe\/2024\/04\/30\/facebook-and-instagram-probed-over-disinformation-handling\">already opened an inquiry<\/a>, back in April, into Meta\u2019s \u201clack [of] an effective third-party real-time election-monitoring tool\u2026\u201d<\/p>\n<p>What if Meta can\u2019t satisfy the latest request? Does that mean the Commission can instruct it to reinstall CrowdTangle, or an adequate substitute, for European users at least? Time will tell. The point I am making here is that Meta should have anticipated that Europe would take a view.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-put-the-cookies-back-in-the-jar\">Put the cookies back in the jar<\/h2>\n<p>Notice I started by referring to European regulators rather than EU regulators. That\u2019s because I also had in mind the way in which the U.K.\u2019s Information Commissioner\u2019s Office (ICO) decisively put its finger on the scale when it came to Google\u2019s attempt to deprecate third-party cookies from Chrome. ICO raised a litany of concerns about adequate privacy protections in the alternative solutions under development at Google and instructed the company that it could not deprecate cookies until the concerns were met.<\/p>\n<p>Google might have thought that, like Mozilla Firefox for example, it could deprecate cookies on its browser whenever it chose. It had overlooked the threat of regulatory intervention.<\/p>\n<p>In my view, Google has now taken the rather nimble step of allowing users to deprecate cookies all by themselves \u2014 at least, that\u2019s what will happen when we see the opt-in (or opt-out) prompt appear on Chrome. Again, my point is that regulators likely had a decisive influence on <a rel=\"nofollow\" href=\"https:\/\/martech.org\/third-party-cookies-will-not-be-deprecated-from-chrome\/\">Google changing course<\/a>.<\/p>\n<p><strong><em>Dig deeper: <a rel=\"nofollow noopener\" href=\"https:\/\/martech.org\/googles-privacy-sandbox-what-you-need-to-know\/\" target=\"_blank\">Google\u2019s Privacy Sandbox: What you need to know<\/a><\/em><\/strong><\/p>\n<h2 class=\"wp-block-heading\" id=\"h-dsa-here-dsa-there-dsa-everywhere\">DSA here, DSA there, DSA everywhere<\/h2>\n<p>It\u2019s the Digital Services Act that has really been stirring the pot recently. The DSA mainly addresses safety and competition concerns relating to very large platforms \u2014 internet portals, if you like, obviously including Google and Meta. But it also has rules for smaller digital services like marketplaces, app stores and travel and accommodation offerings.<\/p>\n<p>The last few months have seen the DSA repeatedly used to bludgeon big tech. For example:<\/p>\n<ul>\n<li>Amazon <a rel=\"nofollow\" href=\"https:\/\/www.reuters.com\/technology\/eus-top-court-rejects-amazons-request-suspend-eu-tech-rules-ad-clause-2024-03-27\/\">lost its appeal<\/a> challenging a DSA requirement to make publicly available a repository containing detailed information on its online advertising.<\/li>\n<li>X\u2019s blue check system was found, in practice, <a rel=\"nofollow\" href=\"https:\/\/www.theguardian.com\/technology\/article\/2024\/jul\/12\/eu-regulators-warns-x-may-face-fines-for-deceptive-blue-tick-system\">to be deceptive<\/a> (there was also the same advertising data repository complaint that Amazon faced).<\/li>\n<\/ul>\n<p>But wait, there\u2019s the Digital Markets Act (DMA) too. Not to be confused with the DSA. Under the DMA, <a rel=\"nofollow\" href=\"https:\/\/www.nytimes.com\/2024\/07\/01\/business\/eu-meta-facebook-instagram-ads-privacy.html\">regulators are investigating<\/a> Meta\u2019s \u201cpay or consent\u201d scheme whereby users paying a subscription get to give up less of their personal data.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-impact-on-marketers\">Impact on marketers?<\/h2>\n<p>For most marketers, this might seem to be an amusing sideshow. But there are two takeaways. First, be aware that platforms you might rely on heavily are being, I\u2019d say, semi-hog-tied. In Europe, at least. Second, for marketers at brands with significant online presence, pay attention to the DSA and DMA just as you were forced to pay attention to GDPR.
