The suit focuses on Apple\u2019s resistance to cross-platform messaging, the lack of compatibility between iPhones and non-Apple smartwatches, barring developers from connecting the tap-to-pay feature with alternative digital wallets and making it difficult for customers to switch to alternative smart phones.<\/p>\n<p>The full lawsuit <a rel=\"nofollow noopener\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.njd.544402\/gov.uscourts.njd.544402.1.0_3.pdf\" target=\"_blank\">can be read here<\/a>.<\/p>\n<p><strong>Taking the walled garden to the next level<\/strong>. The DOJ \u2014 and the fifteen states and District of Columbia who have joined the suit \u2014 accuses Apple of responding to the threat that cheaper smartphones might \u201cdisintermediate\u201d the iPhone, not by offering competitive prices but by making it difficult and expensive to quit the iPhone ecosystem.<\/p>\n<p><!-- \/1038259\/MT_Post-text --><\/p>\n<p>In effect, unlike other so-called walled gardens such as Meta and Google, Apple\u2019s ecosystem is not device-agnostic. It\u2019s possible to interact with Facebook or Instagram using any connected device, but it\u2019s typical of Apple\u2019s features and services that the user has to be within the iOS ecosystem to access them.<\/p>\n<p>Apple, Google and Meta are <a rel=\"nofollow noopener\" href=\"https:\/\/money.usnews.com\/investing\/news\/articles\/2024-03-21\/apple-meta-google-set-to-face-eu-digital-markets-act-probes-sources-say\" target=\"_blank\">also facing scrutiny<\/a> for possible antitrust violations under the E.U.\u2019s Digital Markets Act.<\/p>\n<p><strong>Why we care<\/strong>. There is a quiet war being fought between the walled gardens and the open internet. The DOJ might not have a dog in that fight, but this lawsuit sends a clear warning that you can build the walls around your garden but that you can\u2019t put a roof on it too.<\/p>\n<p>It has to be said, though, that there is one odd thing about this lawsuit. While the pleading quotes <em>prima facie<\/em> problematic statements from Apple executives that appear to show an intent to create a monopoly, one can ask how successful the strategy has been. Android has a worldwide <a rel=\"nofollow noopener\" href=\"https:\/\/backlinko.com\/iphone-vs-android-statistics\" target=\"_blank\">market share<\/a> above 70%, doubtless due to kinder pricing.
