{"id":8356,"date":"2024-08-06T15:14:11","date_gmt":"2024-08-06T15:14:11","guid":{"rendered":"https:\/\/tup.kxe.temporary.site\/the-dojs-case-in-11-slides\/"},"modified":"2024-08-06T15:14:11","modified_gmt":"2024-08-06T15:14:11","slug":"the-dojs-case-in-11-slides","status":"publish","type":"post","link":"https:\/\/okdesign.ca\/fr\/the-dojs-case-in-11-slides\/","title":{"rendered":"The DoJ&#8217;s case in 11 slides"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div>\n<p>Yesterday\u2019s ruling by a federal U.S. judge that <a rel=\"nofollow noopener\" href=\"https:\/\/martech.org\/federal-judge-rules-google-violated-antitrust-law\/\" target=\"_blank\">Google illegally held a monopoly<\/a> in search and text advertising is a staggering defeat for one of the world\u2019s biggest tech companies.\u00a0<\/p>\n<p>\u201cAfter having carefully considered and weighed the witness testimony and evidence, the court reaches the following conclusion: Google is a monopolist, and it has acted as one to maintain its monopoly,\u201d US District Judge Amit Mehta <a rel=\"nofollow\" href=\"https:\/\/www.pacermonitor.com\/view\/VZTUTSQ\/UNITED_STATES_OF_AMERICA_et_al_v_GOOGLE_LLC__dcdce-20-03010__1033.0.pdf?mcid=tGE3TEOA\">wrote in his ruling<\/a>. \u201cIt has violated Section 2 of the Sherman Act.\u201d<\/p>\n<p>While it will be several months before Judge Mehta hands down the penalties, this decision goes to the heart of Google\u2019s business. Whatever the judge decides could upend everything about search and search advertising. Google said it will appeal the ruling, so it will likely be years before we know the outcome.<\/p>\n<p>If you\u2019re wondering why the judge ruled as he did, here is the Department of Justice\u2019s case against the tech giant in 11 slides it used for the closing argument.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-market-share\">Market share<\/h2>\n<p>The Federal Trade Commission <a rel=\"nofollow\" href=\"https:\/\/www.ftc.gov\/advice-guidance\/competition-guidance\/guide-antitrust-laws\/single-firm-conduct\/monopolization-defined\">defines a monopoly<\/a> as \u201cconduct by a single firm that unreasonably restrains competition by creating or maintaining monopoly power.\u201d<\/p>\n<p>Market share is the first thing courts consider when determining if a monopoly exists. There would be no problem if this came by legitimate business practices \u2014 \u201ca better product, superior management or historic accident,\u201d to quote the FTC.\u00a0 As someone around when Google launched in 1998, I can attest that it was a gigantic improvement over other search engines. This is why, by 2002, the company had an 80% search market share.\u00a0\u00a0<\/p>\n<p>But, is that how it maintained that position?<\/p>\n<p>The Justice Department said it was because Google paid other companies to make its search engine the default setting.\u00a0<\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" alt=\"AXBwHvC6bnM4tFQI4HmxYa6VDFGgy ZHs 2f6ogTiBgdw5Vris8Cz17gl paid Apple $20 billion to be the default on iPhones \u2014 the chief competitor of Android, Google\u2019s mobile phone operating system.<\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" only preserved market share, it also prevented others from getting the data needed to create competitive search engines.<\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" important to Google that it designed its Chrome browser to collect it even in the supposedly private Incognito setting.<\/p>\n<figure class=\"wp-block-image\"><img decoding=\"async\" made Google a prime location for digital advertising. The most extreme possibility would be to force Google to sell its Chrome browser and\/or Android mobile software businesses, preventing the company from directly integrating search into both. Also, important to note, there is another federal antitrust suit pending against Google.
